A signed agreement and retainer (if applicable) are required to secure your session date and time. No session date is reserved until payment arrangements are confirmed.
Full payment is due [X days] prior to the session unless otherwise agreed in writing. Payments are accepted via [list payment methods].
All sales are final.
Due to the custom nature of photography services and the time reserved specifically for each client, no refunds will be issued for any reason, including but not limited to change of mind, scheduling conflicts, dissatisfaction with personal appearance, or failure to prepare for the session.
However, if a client is dissatisfied with the technical quality of the images (e.g., lighting, focus, exposure), the Photographer agrees, at their sole discretion, to offer one complimentary reshoot of the session. Reshoots must be requested in writing within [X days] of image delivery.
Reshoots do not apply to:
Clients may reschedule once with at least [48 hours] notice. Additional rescheduling may require a new booking fee.
Failure to appear for a scheduled session without notice (“no-show”) forfeits all payments made.
If the Photographer must cancel due to illness, emergency, or circumstances beyond control, the session will be rescheduled at a mutually agreed time.
Clients are responsible for:
Late arrivals may result in reduced shooting time.
Client acknowledges they are familiar with the Photographer’s portfolio and artistic style. Editing and retouching are performed at the Photographer’s discretion consistent with their brand aesthetic.
Raw, unedited images are not provided under any circumstances.
Final edited images will be delivered via digital gallery within approximately [X business days] after the session.
The Photographer is not responsible for image loss once files have been delivered. Clients are responsible for downloading and backing up their files.
All images are the exclusive intellectual property of the Photographer and are protected under U.S. copyright law.
Clients receive a non-transferable license for personal and/or professional promotional use (e.g., LinkedIn, website, marketing materials) unless otherwise specified in writing.
Images may not be:
Commercial usage beyond agreed terms requires a separate licensing agreement.
Unless otherwise agreed in writing, the Client grants the Photographer permission to use images for portfolio display, website, social media, marketing materials, advertising, and professional competition.
Clients who wish to opt out must submit a written request prior to the session.
In the unlikely event of equipment failure, digital corruption, theft, or catastrophic event resulting in loss of images, liability is limited to the amount paid for the session.
The Photographer is not liable for:
Client agrees to indemnify and hold harmless the Photographer from any claims, damages, or legal actions arising from the use of images or participation in the session.
This Agreement shall be governed by the laws of the State of Texas. Any disputes shall be resolved in the courts located in Tarrant County, Texas.
By booking a session with Scott Alan Photography, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
